SPECIAL PROVISIONS:
~ The tenant on Tract #1,
David Getchell will have the right of ingress & egress through Tract
#3 for the crop removal the fall of 2010.
~ Fence agreement on Tract #1: the north fence, east half is the neighbors
responsibility, the west half is the new buyers responsibility. The WEST
fence line is according to Iowa law.
~ Fence agreement on Tract #2: New owner shall be responsible for all fencing
along the roadways. On the west fence line, the new owner shall be responsible
for the south ½ with the neighbor being responsible for the north
½. On the south fence line, the new owner shall be responsible for
the east ½ with the neighbor being responsible for the west ½.
Concerning the east fence line, the new owner shall be responsible for the
north ½ of the fence along the property owned by Joe Eberhardt and
the Eberhardt's are responsible for the south ½ of the fence on their
property. The new owner shall be responsible for the north ½ of the
fence along the property owned by Don Thomson and the Thomson's are responsible

~ The tenant, David Getchell on the tillable ground for Tracts #1 &
#2 will give fall tillage rights upon completion of the harvest of the 2010

~ It shall be the obligation of the buyer(s) of Tracts #1 & #2 to report
to the Des Moines County FSA office and show filed deeds in order to receive

programs.
~ The seller(s) shall not be responsible for surveying Tracts #1 or #2.
~ Tract #3 has been surveyed by a registered land surveyor.
~ The septic system on Tract #3 was inspected on 10-1-09. Due to this being
an estate, the seller will be exempt from all Iowa septic system laws. Any
future inspections, upgrades, repairs or maintenance to the septic system
will be at the buyer's expense in accordance with Des Moines County &
Iowa Laws & regulations.
~ If one buyer purchases more than one tract the sellers shall only be obligated
to furnish one abstract and deed. Husband and wife constitute one buyer.
~ If in the future a site clean up is required it shall be at the expense
