Special Provisions:
~ This real estate is selling subject
to public road easements and all other easements of record.
~ If one buyer purchases both tracts the sellers shall only be obligated
to furnish one abstract and deed. Husband and wife constitute one buyer.
~ The buyer of Tract #1 shall be responsible for any desired fencing in
accordance with Iowa state law and the buyer of Tract #2 shall be responsible
for any desired perimeter fencing.
~ The tenant, David Richardson has a lease on the tillable land being sold
located in the E1/2 of the SW1/4 until March 1, 2011. The annual cash rent
of $9,923.94. On the day of closing the sellers shall reimburse the buyer
$4,961.97 for the March 1, 2009 payment. The $4961.97 payment due on November
1, 2009 shall be paid directly to the buyer from the tenant. Like payments
shall be made on the same dates in 2010.
~ It shall be the obligation of the buyer of Tract #1 to serve termination

~ Due to Iowa's new Septic Tank Inspection Law the seller will bring the
system on Tract #2 up to code prior to closing.
~ On the day of closing the buyer of Tract #2 shall reimburse the seller
for the remaining gas in the LP gas tank at the current per gallon rate.
~ The tenant has the right to use the entrance on Tract #2 until the expiration
of the lease. (March 1, 2011)
~ If in the future a site clean up is required it shall be at the expense
of the buyer.
~ The buyers acknowledge that they have carefully and thoroughly inspected
the real estate and are familiar with the premises. The buyers are buying
this real estate in "as is" condition and there are no expressed
